Our Privacy Policy explains how EXAR collects, uses, and discloses information about you. The terms “EXAR,” “we,” “us,” and “our” include EXAR Studios Inc. and our affiliates. We use the terms “user,” “you,” and “your” to mean any person using our Platform or attending gatherings, including any organization or person using the Platform on an organization’s behalf. This Privacy Policy applies to the processing of information about individuals that we collect when you use our “Platform,” which means any website, application, or services we offer, or when you communicate with us. For information about choices you may have under this policy, please see “Your Choices” below. This Privacy Policy does not apply to the information that you may provide to third parties, such as individuals, and others with whom you may share information about yourself. For more information about the scope of our Privacy Policy, please see Section 4.4.
To make this Privacy Policy easier to understand, we have provided summaries in grey boxes below. These summaries are not part of the official policy. Even though we have provided summaries, it is important for you to read the entire policy carefully.

1.1 Information You Provide to Us. We collect information that you provide directly to us. For example, we collect information that you provide when you create an account, choose interests, fill out a form, or communicate with us. The types of information that we may collect include identifiers, such as your name, username, password, email address, postal address, and phone number; payment and commercial information, such as payment method data and purchases, if any; demographic information and any other personal information that you choose to provide, such as photos, choices of interests, gender, date of birth, groups, and professional or employment-related information, including your role, company, and years of experience. Certain information about yourself, such as gender and date of birth, is optional to provide. Your choice of interests is also optional, but we are required to process this information in order to administer your account, and to indicate that you are attending gatherings that you join. See Section 2 to learn how we will use the information that you provide to personalize our recommendations and other content to you.
On occasion, the information that you give us when you join a gathering may imply information about your beliefs, political views, health conditions, or your sexual identity. This, and other kinds of sensitive information, is given special protection in accordance with applicable law. Posting personal or sensitive information about others without their permission is prohibited.
1.2 Information We Collect Automatically When You Use the Platform. When you use our Platform, we automatically collect internet and other electronic network activity information about you and other information, including:

3.1 Through Our Platform. We share some of the information that we collect by displaying it on our Platform according to your user profile and account settings. Some information, such as username, is always public. Some information, such as interests, is public by default, but can be hidden on our Platform. Some information, such as gathering attendance, will always be visible to other users.
Information that is public on our Platform is visible to others on and off the Platform.
3.2 Subscribers. Subscribers have access to the content within their gatherings, including information about gathering attendees and signups. Subscribers find it helpful to have access to the email addresses of users who attend or sign up to gatherings, to easily communicate with and administer the gatherings. Therefore, we may provide ways for you to share your contact information with subscribers.
3.3 With Our Service Providers. We may use service providers in connection with operating and improving the Platform to assist with certain business purposes, such as payment processing, email transmission, conducting surveys or contests, data hosting, managing our ads, and some aspects of our technical and customer support. These service providers, which include data analytics providers (as discussed further in Section 3.5 below), may access, process, and store information about you on our behalf for the purposes we authorize, subject to confidentiality obligations.
3.4 With our Analytics and Advertising Partners. We may share information we have collected about you with others or allow others to use technologies (like cookies, web beacons, and device identifiers) that collect information about your use of the Platform and other websites and online services, to provide analytic services and to serve ads for EXAR.
Depending on where you live, you may have the right to opt-out of the sharing of your personal information for purposes of targeted advertising (targeting ads based on consumer activity across other sites and services). EXAR provides you the opportunity to opt-out of this sharing, as described in Section 5 below.
3.5 Following The Law And Protecting EXAR. We may access, preserve, and disclose information about you to government entities and other third parties, including the content of messages, if we believe disclosure is in accordance with, or required by, applicable law, regulation, legal process, or audits. We may also disclose information about you if we believe that your actions are inconsistent with our Terms of Service or related guidelines and policies, or if necessary to protect the rights, property, or safety of, or prevent fraud or abuse of, EXAR or others.
3.6 Social Sharing And Other Tools. The Platform may offer social sharing features and other integrated tools which let you share actions that you take on our Platform with third-party services, and vice versa. Such features let you share information with your friends or the public, depending on the settings you have chosen with the service. The third-party services’ use of the information will be governed by the third parties’ privacy policies, and we do not control the third parties’ use of the shared data. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please review the privacy policies of the services that provide these features.
3.7 Affiliate Sharing And Merger, Sale, Or Other Asset Transfers. If EXAR is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of our assets, information about you may be shared, sold, or transferred as part of that transaction. We may also share information about you with current or future corporate parents, subsidiaries, or affiliates.
3.8 Other Situations. We may de-identify or aggregate information about you and share it freely, so that you can no longer be identified. Such information is not subject to this Privacy Policy.
We may also share information about you with your consent or at your direction or where we are legally entitled to do so. For example, your information may be shared with gathering sponsors and others as described to you when you sign up to a gathering. Your information also is made available to other users and subscribers when you sign up for and participate in a gathering.

4.1 Transfer Of Information To Canada And Other Countries. EXAR is based in Canada. Information about you will be transferred to, and processed in, Canada, the U.S., and countries other than the country in which you are resident. These countries may have data protection laws that are different to the laws of your country and, in some cases, may not be as protective. We have taken appropriate safeguards, such as standard contractual clauses, to require that your information will remain protected in accordance with this Privacy Policy.
4.2 Security. We employ technical and organizational measures designed to protect your information that is under our control and that we process on your behalf from unauthorized access, collection, use, disclosure, copying, modification, or disposal, both during transmission and once we receive it. For example, we store all information that you provide to us on servers on which security controls are used. We train employees regarding our data privacy policies and procedures, and authorize employees to access personal information as required for their role. However, no method of transmission over the internet or method of electronic storage is completely secure.
Where you have a password, which enables you to use our services, you are responsible for keeping this password complex, secure, and confidential. If you would like to update or change your password, you may select the “Forgot your password?” link on the login page. You will be sent an email that allows you to reset your password.
4.3 Data Retention. We may temporarily de-activate your account if you have not logged in for six months or more. You may contact us if you wish to reactivate your account.
We retain certain information that we collect from you while you visit or are a user and/or subscriber of the Platform, and in certain cases where you have deleted your account, for the following business purposes:
When we have no ongoing legitimate business need to process your information, we will either delete it or take steps to de-identify or anonymize it in accordance with applicable law.
4.4 Policy Scope. This Privacy Policy does not apply to information that you have provided or made accessible to third parties, such as other users, subscribers, and others with whom you may share information about yourself. Our Platform may direct you to a third-party service, such as social media services, or a portion of our Platform may be controlled by a third party (typically through the use of a frame or pop-up window separate from other content on our Platform). Disclosure of information to these third parties is subject to the relevant third party’s privacy policy. We are not responsible for the third-party privacy policy or content, even if we link to those services from our Platform or if we share information with these third parties.
Users and subscribers are directly responsible for complying with all requirements of applicable privacy laws in connection with the information that they obtain and process for the purposes of managing their contacts, organizing and communicating with other users and subscribers, or creating and hosting gatherings.
4.5 Revisions To This Policy. We may modify this Privacy Policy from time to time. When we do, we will provide notice to you by publishing the most current version and revising the date at the top of this page. Depending on the circumstances, we may provide additional notice to you of changes to this Privacy Policy, such as by sending you an email or by displaying a prominent notice on our Platform.

5.1 Account Information. You may update or correct your account information by editing your account settings or by sending a request to support@exarstudios.com as described in Section 6 and Section 7. You may deactivate your account by editing your account settings. You may also request deletion of your information as described in Section 6 and Section 7. You will also be able to choose what information others see about you and who may contact you by using the Privacy Settings section in your Account.
5.2 Location Information. When you first access the Platform, depending on your device settings, we will collect information about your location, which we use to make better recommendations for content in your area, and to improve our Platform. If you do not want us to collect information about your location, then you can prevent this by taking the following steps:
Note that our Platform or its features may no longer function properly if you change your settings.
Your mobile device settings may also give you the option to choose whether to allow us to view your geolocation on a continuous basis, only when using the app, or never. Allowing us to view your geolocation when you are not using the app allows us to provide you with recommendations on a regular basis. Please refer to your device’s guide for additional information on how to adjust location services.
5.3 Cookies. We may use and allow others to use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Platform and other websites and online services.
As stated above in Section 3.4, depending on where you live, you may have the right to opt out of the sharing or processing of your personal information for purposes of targeted advertising (targeting ads based on consumer activity across other sites and services), and you may be able to use your Cookie Settings to select cookies you would like to opt opt-out of, including those used for targeted advertising purposes.
5.4 Promotional Communications. You can control some of the messages that you receive from EXAR, other users, and subscribers by selecting the unsubscribe link in the message that you receive, or by adjusting the communication preferences in your account settings. We will also send you a link to these settings when you first sign up and in subsequent messages. If you opt out, we may still send you non-promotional messages, such as those about your account or our ongoing business relations. In addition, please consult the privacy policies of subscribers for information about how to control or opt out of promotional messages from them off the Platform.

We respond to all requests that we receive from users who wish to exercise their data protection rights in accordance with applicable data protection laws. You can contact us with your request by sending an email to support@exarstudios.com. You can also request deletion of your account and personal information by clicking the “Delete account and personal information” link in your profile settings on the mobile app.
Subscribers who want to delete their account and personal information from the Platform, can do so in their account settings. If you are a subscriber, we will wait a few days to process your deletion request, and your request will be withdrawn if you create any content within 7 days of submitting your deletion request. Content that was publicly posted to the Platform will not be deleted as it does not constitute personal data. Identifying data like logos, business names, address, etc will be removed from the content unless that information is added to the description. If you would like this information to be deleted from the description, please remove it manually prior to deleting your account.
Rights that you may have, depending on the jurisdiction in which you live, may include:
Note that EXAR is a controller of your information. Other users and subscribers may also act as controllers of your information. You should contact these users and subscribers if you have any questions about how they use information that you have provided to them.
We will not discriminate against you for exercising your rights and choices, although some of the functionality and features available on the Platform may change or no longer be available to you.
During the preceding 12 months, EXAR has collected, used, and shared the categories of personal information described above in this Privacy Policy. We do not consider the ways we share your information as a “sale” for purposes of California law. California residents have certain rights to access, correct and delete their personal information and to request transparency about our privacy practices. If you would like to access or delete your information, or otherwise exercise your rights under the CCPA, please see Section 6. Once we receive your request, we may verify it by requesting information sufficient to confirm your identity, including by asking you for additional information. If you choose to exercise your rights, we will not charge you different prices or provide different quality of services for exercising your rights unless those differences are permitted by law.
If you are a California resident and would like to use an agent registered with the California Secretary of State to exercise your rights, we may request evidence that you have provided such agent with power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.
Do-Not-Track Signals. Some mobile and web browsers transmit do-not-track
signals. Because of differences in how web browsers incorporate and activate this
feature, it is not always clear whether users intend for these signals to be
transmitted, or whether they even are aware of them. We currently do not take action in
response to these signals.

All subscriptions automatically renew, but your subscription may expire for two reasons:
If either of the above happens, your subscription will stay active until its scheduled expiration date.
After that moment, your account will enter a 14 day grace period, during which you can always update your payment details to keep your subscription from expiring. If the subscription expires, you’ll lose access to the features of the Platform that you were paying for. However, you can start a new subscription at any time.
When the grace period ends, your content will be removed from publicly accessible portions of the Platform.
We may permanently delete your information from our Platform at any time after the grace period.
Once your content is permanently removed, it cannot be recovered on our side. However, you’re always welcome to create new content after you start a new subscription.
EXAR only issues refunds to eligible subscribers who started a subscription on EXAR’s website or through the Google Play Store. Consumer protection regulations may apply to subscribers in the European Union.
EXAR will issue refunds for payments if requested within 14 days of the first charge. This does not apply to monthly subscriptions.
EXAR will issue refunds for renewal payments if requested within 30 days of the subscription’s auto-renewal. This does not apply to monthly subscriptions.
To stop your subscription from renewing automatically, you can cancel your subscription at any time.

If you’ve purchased a subscription through the Apple App Store, all refunds are handled by Apple and subject to Apple’s Terms of Sale. To request a refund for an App Store purchase, contact Apple Support.
If you’ve purchased a subscription through the Google Play store, all refunds are handled by Google and subject to their refund policy. To request a refund for a Google Play purchase, contact Google Play support.
Profiles are intended to represent real people, businesses, and creators. Profiles must be honest and authentic.
All users and subscribers should be open about who they are, their intentions, and their affiliations. All content descriptions should be accurate, so users can make informed decisions about their participation and viewing of content.
Gatherings, business, and creator feedback and ratings are important indicators of a user’s experience, and are meant to offer relevant and valuable insights into a user’s experience. All users and subscribers should leave ratings or feedback that accurately reflects their experience. For example, it is a violation of our policies to leave a negative rating solely in an attempt to harm the ratings for someone you dislike.
Creating fake accounts, malicious accounts, or accounts meant to impersonate another person, is prohibited on the Platform.
The Platform is intended to be a place where people can connect safely and respectfully online and offline. This includes respecting people’s time, attention, personal choices, and personal boundaries. Be respectful in interactions with people and in content posted on the platform. We may monitor and restrict behaviors that are dishonest, undermine the integrity of the platform, violate personal boundaries, or serve to intentionally upset people.
Content sent to a user that is irrelevant, impersonal, unsolicited, promotional, or repetitive is spam. We may restrict access to features or the Platform based on reports of spam
Posted content like gatherings, tours, and other content must align with the expectations of the user. Content descriptions and titles should clearly indicate the experience the user will have when viewing or interacting with that content.
Our platform was built to solve loneliness in local communities. We believe it’s important for people to connect with one another, make friends, and enjoy company. We help businesses and creators build communities that don’t just buy products. These people care for each other and build the future of the community in their local region.
To make this possible, EXAR requires content to meet some basic requirements:
Gatherings, tours, and other content on the Platform should give users the opportunity to have a deeper connection with their local community. Here are some examples of how that can be accomplished:
Content on the platform should help create friendships, connection, and empathy between people. While we understand that businesses and creators need to create business outcomes using our tools and features, building for connection is the best way to ensure users are engaged and want to keep coming back.
Here are some examples of content that can be used as inspiration:
Users and subscribers should work together to create content that is in the best interest of the community. In certain circumstances, users and subscribers may represent a business with financial interests. Deliberately sabotaging a business’s ability to reach their audience, run their business, or create for the community using our tools or features is prohibited.
We encourage businesses to collaborate with one another for mutual benefit in creating content that will increase user engagement.
While not strictly enforced, we strongly encourage subscribers to create content that is unique from other existing content on the Platform. Think about what makes your brand special and create gatherings, tours, audio, text, and images that help you stand out from the crowd.

coffee and themes in their branding

Users must accept and respect any subscriber’s decision to ban a user from viewing or interacting with their content, or a user’s decision to block another user from contacting them on the Platform. Users and subscribers must also respect any decision from EXAR to suspend or terminate their account due to a policy violation. Creating new accounts to circumvent a block or ban decision from a subscriber, a user, or EXAR is prohibited. Additionally, you are not permitted to post or promote content on behalf of a user that has been banned or blocked from using the Platform.
Here are some examples of content that should not be posted to the Platform:
Pornography is not allowed on the Platform. Publicly shared photos must be appropriate for general audiences. Nude or sexual photos are not permitted.
Nudity, sexuality, sex solicitation, and prostitution are not permitted in any content including but not limited to messaging, gatherings, augmented reality, photos, text, or audio. In regions where these activities are prohibited by law, EXAR may choose to report these activities to relevant authorities.
Gratuitously graphic, disgusting, obscene, or violent content is prohibited. We don’t allow content posted to upset, shock, or disturb users or subscribers.
EXAR has a zero tolerance policy regarding child nudity of any kind, pornography, or anything EXAR Studios Inc. believes exploits, sexualizes, or fetishizes minors. Such content will be removed from the platform and the uploader will be banned. EXAR reports all child pornography to the relevant authorities.
Do not switch content descriptions and titles at the last minute to get users to attend or view content they hadn’t originally intended to.
Do not fill gatherings with attendees in an effort to make them seem more popular or active. Especially do not create fake accounts for this purpose.
Using profanity in an attacking, sexual way, or in a way intended to offend people, is prohibited.
In order to provide a quality experience to our users, titles and descriptions of all content are to be relevant, useful, and easy to understand. Excessive or improper use of punctuation, symbols, capitalization, spacing, URLs, emojis, or repetition, intended to grab attention for a group or event, will need to be edited.
We consider the following examples to be excessive or gimmicky use of numbers, symbols, punctuation, repetition, or spacing: !!Party!!!, ARTNIGHT, e_v_e_n_t, b04rdg4mezzz, l e t s g o, or 🤩 🤩🤩🤩🤩🤩🤩.
EXAR defines consent as welcomed communications and actions to engage with a user. Engaging with anyone in a non-consensual way is strictly prohibited. If ever in doubt, ask permission.
Posting private information of other users or subscribers without their explicit consent is prohibited.
Users and subscribers should always be mindful of privacy and use discretion when sharing any private content that belongs to themselves or to other users or subscribers. For example, phone numbers, social security numbers, addresses, financial information, passwords, and government identification are considered private information.
Bullying, harassment, exploitation, and acts of hate undermine community building in safe spaces where people can trust one another. Building real relationships requires us to be more compassionate and kinder towards one another. EXAR enforces against behaviors that are threatening, intentionally malicious, or personally harmful - physically, emotionally, or mentally.
Harassment and bullying are not allowed on the Platform. EXAR will honor requests to remove content that publicly shames or degrades a private individual.
Users should first contact the uploader to request that content be removed.
Harassment is persistent or non-consensual contact from another user or subscriber. Bullying is the intentional posting of mean content for the purpose of hurting or embarrassing another.
Any attempt to use someone’s insecurities or vulnerabilities for personal gain is considered manipulation or exploitation and is prohibited.
Hate speech, supremacy, or behavior that incites hate or violence against individuals or groups of people based on who they are or their beliefs, is prohibited.
All users and subscribers should take ownership over their personal safety and should never put themselves or others in danger. We expect all users and subscribers to be mindful of local laws when engaging with others. Where appropriate, subscribers should also set guidelines for their gatherings and content to ensure users are participating safely.
Using the Platform to promote, facilitate, or organize violent, criminal, or non-consensual actions that endanger anyone, physically, mentally, or emotionally, is prohibited.
EXAR reserves the right to remove credible explicit and implicit threats of violence or aggression and revoke the access to the Platform of the user who made them. Examples of prohibited implicit threats include, “The next time I see you, you’ll be sorry.” and “You better watch your back.”
The dissemination or promotion of misinformation is prohibited. This includes claims that have been scientifically disproven and that may pose a public or personal health risk.
Content that encourages or glorifies self-injury or encourages others to harm themselves is prohibited.
We cannot provide access to any deceased user or subscriber’s account, even to family members or people acting on the behalf of the estate.
We may remove certain users or subscribers when we become aware that they are a convicted sex offender or have been convicted of a violent, fraudulent, or dangerous crime. We may also remove a user or subscriber based on their criminal record, for safety, or for other concerns. Users and subscribers with concerns about criminal or illegal activity should always report it to local authorities. We may or may not perform criminal background checks on users or subscribers at our sole discretion.
Certain portions of the Platform may be restricted to users above the age of 18. If you do not provide your age in the onboarding process, these portions will be restricted by default.
Subscribers must strictly be above the age of 18.
We respect the intellectual property rights of others. Posting content that violates another party’s intellectual property rights is prohibited.
When provided with the requisite information, EXAR will remove or disable access to material that infringes on the intellectual property rights of others or remove accounts of those who may be repeat infringers. Please note that simply hosting an gathering around a similar topic in a shared location is generally not considered a violation of our policies.
If you believe that content on the Platform violates another party’s intellectual property rights, you should contact the rights owner directly so that they may evaluate the use of their material and determine whether to report the situation to us.
If you believe that content on the Platform violates your intellectual property rights, please send a notice containing the information below to us by email at support@exarstudios.com.
Please note that if the information contained in your take down notice is knowingly misrepresentative with regard to alleged infringement, a court may hold you liable.
If you are unsure whether content appearing on the Platform is infringing on your intellectual property rights, you should consider contacting a lawyer.
Please submit this information in the format below and in English. If the content at issue is claimed to have infringed on someone’s copyrights, then this notice must include the following:
1. Your name, mailing address, telephone number and email address
Note that we may provide your contact information to the user or subscriber that has posted the content you claim is infringing.
2. A description of the content or other material that you claim has been infringed.
Although not required, please provide us with copies of or reference to (with registration numbers, where applicable) the content that you claim has been infringed.
3. A description of where the material that you claim is infringing is located on the Platform.
Please provide specific locations (URLs, screenshots, etc) where the content is located. Also please provide a specific description of the material that you are claiming is infringing so that we are able to identify it in the specified location.
4. An explanation of how the content on the Platform infringes on your intellectual property rights.
Note that providing this information is optional. However, by providing this information in your initial report you may help us better understand the situation without seeking additional information, which may result in a faster resolution of the situation.
5. A statement by you that you have a good faith belief that the disputed use is not authorized by the owner, its agent, or the law.
6. A statement by you, that the above information in your notice is accurate, and under penalty of perjury, that you are the copyright or intellectual property owner or authorized to act on the owner’s behalf.
